Owner of Derbyshire land with high hedge is issued with notice to take remedial action after complaint to council
The council recommends that the hedge should be cut back.
The owner of a high hedge has been issued with a notice to take remedial action after a complaint was made to a Derbyshire council.
The hedge, which is formed predominantly of pine trees, is in the rear garden of a property on Birchwood Lane, South Normanton and is approximately 16 metres from the rear elevation of a house at Elmhust Close, South Normanton.
Bolsover District Council has decided that the hedge is adversely affecting the reasonable enjoyment of a property at Elmhurst Close, South Normanton and that action should be taken to remedy this effect and prevent its recurrence.
The notice served on the owner or occupier of the land at Birchwood Lane requires that the hedge be reduced to a height not exceeding 9.50 metres. It is recommended that the work be carried out by a skilled contractor.
Failure to adhere to the notice within 12 weeks of December 4 could result in prosecution at magistrates court and a maximum fine of £1,000.
The council recommends that the hedge should be cut back annually to a height of 9.50 metres. This allows room for the hedge to re-grow between annual trimmings and still not exceed a height of 10 metres.
