Pub near Chesterfield appeals decision to strip it of licence after alleged Covid-19 lockdown breach

The landlord of a pub near Chesterfield which allegedly stayed open early during the Covid-19 lockdown has appealed against a decision to revoke its licence.

The Royal Volunteer, on Market Street, Clay Cross, was stripped of its licence by North East Derbyshire District Council’s licensing sub-committee last month.

It had been accused of putting people ‘at serious risk of harm’ by staying open on March 21, after the coronavirus lockdown regulations came into effect that day.

Now North East Derbyshire District Council has confirmed that the pub has appealed against the breach before the deadline which had been set of Friday, July 31.

Duncan Mark Waring, listed as the licence holder, was invited to attend the licensing review hearing when it was held in July but declined to do so.

As a result the application for the licence review, which had been made by both the council’s environmental health service and licensing authority, was heard in his absence.

Environmental health officers provided evidence that the premises regularly operated outside its permitted hours when holding events and had caused a public nuisance by playing loud music, according to the council.

The council also said Derbyshire police had provided evidence that the pub had opened on March 21.

Councillor Heather Liggett, chair of the licensing committee, previously said she appreciated ‘times are hard at the moment for those within the hospitality industry’ but the pub had put profits before the health of the public.

The appeal will be heard before magistrates but a date for the hearing is not yet known.
