‘Disabled’ Glossop cheat caught playing golf

Dennis Simms admitted failing to notify the Department for Work and Pensions that his capabilities had improved between January 2009 and July last year.

Derby Crown Court heard on Friday that the 66-year-old, of Wrens Nest Terrace, claimed a total of £12,059.59, which he has already started paying back.

Prosecutor Edna Leonard said the defendant had told the government he had difficulty walking, but after investigations he was seen playing golf.

“He was seen to be standing, walking, bending and carrying golf clubs,” she said.

The court heard his outstanding balance was £10,889.03 and that he had arranged to cash in a life insurance policy and withdraw funds from his ISA so he could pay off the remainder.

Denise Ftizpatrick, defending, said the disability living allowance was not paid directly to him but to a company who provided him with a mobility car.

Judge John Burgess ordered Simms to pay a £10,889.03 confiscation order, a £1,000 fine, £300 costs and a £50 victim surcharge within six months.
