Victim's family slams 'disgusting' sentence for 'one-punch' Chesterfield killer

The family of a Chesterfield dad killed by a single punch has criticised the ‘disgusting’ sentence handed to his attacker.

Jordan Maltby, 26, hit Phillip Allen once in the face during a disagreement about alcohol outside his home and was jailed for seven years and four months for manslaughter.

Maltby, of Gloucester Road, Stonegravels, was given a further five-year extended licence period due to the danger he posed and must serve a further eight months after activating a suspended sentence.

Phillip’s sister Jane Allen said the sentence was ‘disgusting’ and she believes Maltby is capable of killing again.

“I am shocked by how lenient the sentence was,” Jane said. “Even the judge said at the end he could re-offend and it could be another family going through the hell we have gone through over the past few months.

“Throughout the court case Maltby didn’t show any empathy. He just stood there looking forward and yawned at one point. He has got off so terribly lightly.”

Phillip suffered multiple fractures to his face as a result of the attack on June 27, 2019 and collapsed to the floor outside his home on Highfield Lane.

As he fell backwards he banged his head on the kerb causing a serious skull fracture.

After being rushed to hospital it was found Phillip had a bleed on the brain and he was placed in an induced coma before tragically dying three weeks later.

“Phillip loved life and was a real father-figure for my son Luke,” Jane said. “I recently found a card he sent to me when I was battling cancer.

“It said ‘life is for living’ – but tragically three days later Phillip was in a coma.”

Detective Inspector Steve Shaw, who led the investigation into Phillip’s death, said: “This case shows once again the fatal consequences of a single punch.

“As has been seen numerous times across our county what was a trivial disagreement has ended in an absolutely tragic manner.”
