Chesterfield man ended up in court after he hit his former partner on the head with a sandwich

A Chesterfield man assaulted his former partner with a Subway sandwich in a row while he was leaving the home they shared with their baby, a court heard.

Chesterfield Magistrates’ Court was told on Thursday, September 24, that Aaron Cooper had been in a relationship with the woman for around 18 months and they had a five-month-old child together.

But the relationship had broken down and Cooper had gone around to the address to collect his belongings and to see the baby when the incident occurred on July 25 at Canal Wharf, Chesterfield.

As part of the altercation, Cooper, 23, had tried to climb over a sofa to get away from his former partner while holding the baby, and he believed the child’s head had bumped against the wall, inflaming the situation further.

Prosecuting, Sarah Haslam said: “They were arguing about the child and he has grabbed a sandwich and hit her over the head with it. He said he had got the child and he thought it had hit its head on the wall.”

She added that Cooper, now of Brampton Court, Old Road, Chesterfield, had made threatening gestures towards the woman but had told police he had no intention of hitting her.

Cooper admitted common assault when he appeared before the court.

Mitigating, Steve Brint said: “A relationship of 18 months is a long relationship, especially when a young person is involved, and it’s difficult when a relationship breaks down, but it was over and access to the child was being restricted to him at that time.

“He attended the property and went upstairs to see his son, and there had been an argument and he picked the child up and she followed him around the house shouting at him.

“He climbed over a sofa to get away from her and he believed at that time that his son had banged his head. He had a Subway sandwich in his hand which was in a sleeve. He swung the sandwich and it came out of the sleeve and gone flying through the air.”

He added that Cooper was now living with his mother and was being allowed access to the child.

Cooper was fined £294 and ordered to pay £85 in prosecution costs and a £34 victim surcharge.
