Jamie Hudson, 20, of Devonshire Avenue North, appeared at Chesterfield Magistrates’ Court on Monday where he pleaded guilty to possession of an offensive weapon in a public place and assaulting two police officers.

The court heard that on November 4 he went to a pharmacy on High Street in New Whittington where he asked for some haemorrhoid cream. He got angry when they did not have the cream he wanted.

Becky Allsop, prosecuting, said: “He said ‘You better have it next time or I’m going to kick off, I’ve got a sledgehammer.”

He started waving the hammer around outside the shop leaving the shop assistant frightened, sick and scared.

Two police officers went to his home where he became agitated and refused arrest. When the officers tried to put handcuffs on him he head-butted one of them.

Ms Allsop said: “PC Troth had to spray him with CS spray for fear of being assaulted again. Mr Husdon was saying ‘I’m going to have you’. The officer activated the emergency button for other officers to attend. He could feel blood in his mouth. The other officer was trying to assist and was hit in the face. She suffered pain to her neck and forearm and went to hospital for x-rays.”

A report by the probation service said Hudson had been under the influence of legal highs and had not been able to give any other explanation as to why he behaved in that manner.

The court heard he had not taken legal highs since December and had suffered a psychotic episode for which he is now on medication for.

Defending, Kevin Tomlinson, said: “Mr Hudson had been working as a mechanical engineer but was sadly made redundant. He seems to have deteriorated in his personal life because of an addiction to legal highs.

“He wishes to apologise to the officers and counter staff. He expresses significant remorse.”

Hudson was handed a 12 week jail term, suspended for 12 months. He will pay a total of £235 in costs.
