Booze-fuelled man kicked two police officers

Chesterfield magistrates’ court heard on Tuesday, February 23, how Daniel Jozefczyk, 34, kicked two officers after police were called out to a domestic-based incident in Glossop on February 10.

Prosecuting solicitor Ian Shaw said: “Police described him as being drunk and aggressive and he repeatedly made threats and would not listen to reason and he was arrested to prevent a breach of the peace.

“It was believed he had had two bottles of red wine and half-a-bottle of whiskey and he raised a pint glass and officers feared they would be assaulted.

“He made his way to a garage where there was a struggle with police and they asked for assistance and he was handcuffed but kicked one officer in the shin and another in the hand.”

The court heard how Jozefczyk attended Buxton magistrates’ court on Monday, February 22, where the assault offences were to be to be dealt with but he was deemed too drunk to offer any pleas.

Mr Shaw added: “He was escorted into a public area where he became aggressive and was seen drinking and the police were called. As a result he was arrested for being drunk and disorderly.”

Police once again struggled to detain Jozefczyk, according to Mr Shaw, and he was swinging his arms about and he had to be restrained before being taken to hospital.

Jozefczyk, of Kiln Way, Wellingborough, pleaded guilty to two counts of assaulting police officers and to one count of being drunk and disorderly.

Defence solicitor Julie Page said alcohol has become a problem for Jozefczyk in the last 12 months after the breakdown of his marriage and because of contact difficulties with their children.

She also explained his binge-drinking occurs when he returns to Derbyshire to make contact with his estranged wife.

Ms Page added: “The kicks were during a struggle rather than as a deliberate intention to kick officers.”

Magistrates sentenced Jozefczyk to a 12 month community order with a Rehabilitation Activity Requirement and a substance to solutions programme.

He was also given 100 hours of unpaid work and ordered to pay £85 costs, £100 compensation and a £60 victim surcharge.
