Banned driver’s suspended jail term

A disqualified motorist who was caught driving during his ban has been given a suspended jail sentence.

Chesterfield magistrates’ court heard how Gareth Warne, 32, of Lyndale Drive, Codnor, had been banned for 12 months from October for drink-driving but was spotted driving by police.

Prosecuting solicitor Ian Shaw said police spotted Warne in a BMW in Clowne and they followed him until he parked on nearby Blackberry Court and a driver database confirmed he is a disqualified driver.

Jobless Warne pleaded guilty to driving while disqualified and to using a vehicle when an insurance policy was not in force.

Robert Sowter, mitigating, said the former groundsman committed the offence when he had expected a lift to work but had been let down. Magistrates sentenced Warne on January 29 to a 12 week custodial sentence suspended for 12 months.
