Chesterfield magistrates’ court heard on Wednesday, June 29, how Kirsty Louise Baxtor, 29, of High Street, Heanor, stole a bottle of Cactus Jack’s alco-pop worth only £5.99 from a Lidl store in Chesterfield.

This alco-pop theft happened on May 3 before Baxtor had been dealt with separately for other thefts with a suspended custodial sentence, according to prosecuting solicitor Becky Allsop.

Mrs Allsop said: “A security guard at Lidl had seen Baxtor and the defendant had raised suspicions because she was looking around and had stopped at the alcohol aisle and she picked up an alco-pop and put it in a bag and walked out.

“The security guard followed her and Baxtor tried running away on a couple of occasions but she was detained.

“She told a police officer during her arrest that she only stole the alcohol because the queue was too big and she couldn’t be bothered to wait.”

Baxtor pleaded guilty to stealing the alco-pop after the offence on May 3.

Defence solicitor Kirsty Sargent said: “She’s been struggling financially and with a drug addiction and she feels perhaps prison is the only way to clear her mind.

“It’s unusual but it’s what she’s requesting as a chance to get away from drugs and to get her head sorted.”

Magistrates revoked Baxtor’s existing suspended prison sentence and her existing fines before sentencing her to 12 weeks of custody.

She was also ordered to pay a £115 victim surcharge.
