Reveller attacked Regal club owner in Ripley

Chesterfield magistrates’ court heard on Wednesday, November 11, how Kyle Hayden Harvey, 23, admitted punching the owner of the Regal, Sean Fields, following a fracas.

Prosecuting solicitor Angela Hadfield said: “The defendant was drunk and angry and was being restrained by doorstaff and was ejected from the club after being aggressive to other customers.

“He further resisted the doorstaff and had to be restrained against a railing and he spat at the club owner.

“The defendant was told to leave and moved away and called 999 on his mobile phone to say his phone had been stolen even though he was using it to make the call.

“After a short time Harvey then threw a punch at the back of Sean Fields’ head as he was greeting customers and the defendant had to be restrained again by doorstaff.”

CCTV footage, according to Mrs Hadfield, showed Harvey being ejected and restrained before he was released and then seen staggering around and then throwing a punch at Sean Fields.

Mrs Hadfield added: “The CCTV shows Harvey throwing a punch and Mr Fields ducks and the punch landed on his back and shoulder.

“The defendant was again tackled by doorstaff and he was punched by members of the doorstaff to keep him away from Mr Fields and there is fighting and the defendant is restrained.

“Mr Fields said that as a result of the defendant’s punch he has suffered passing pain and discomfort but has not been left with any permanent injury.”

Harvey of Red Lion Square, Heanor, pleaded guilty to committing the assault on June 21.

Defence solicitor John Last persuaded the court to consider a pre-sentence report from the probation service due to the defendant’s previous convictions. Magistrates sentenced Harvey to a 12 month community order with a rehabilitation activity requirement and 60 hours of unpaid work. He must also pay £50 compensation, £85 costs, a £60 victim surcharge and a £150 courts charge.
