The application, from Steve Dosanjh for the former Smalley Stores in Main Road, Smalley has been submitted to Amber Valley Borough Council.

It will be decided in the next few months.

Details filed with the application say that the shop has been closed for more than five years.

It is now planned to divide the building in two, with one half remaining a shop and the other half becoming a hot food takeaway.

The shop is planned to open in April, it says.

However, nearly 100 residents are opposing the plans due to existing parking and traffic issues in the village.

They also fear an increase in bad odour and litter.

Philip Surridge, who lives next door to the planned development, has been canvassing neighbours to gather objections and has nearly 100 signatures.

Mr Surridge, who has lived in the village for seven years, said: “The shop had financial difficulties before and closed

“There had been plans to partition it and open it up as retail and a hot food takeaway, but the council put a stop to that and now there is a planning application.

“The parking here is already horrendous, this is a residential area and is a main road through to Derby.

“I don’t think there is any consideration for neighbours at all.”

Another resident has also lodged an objection to the borough council, writing: “I cannot think of any reason why Smalley requires a hot food takeaway shop.

“All neighbouring villages and towns offer a multitude of culinary delights delivered right to your door, so I question the need for this.

“How can the applicant state that this will be a successful business?

“The increase in noise, traffic, litter, smells and fumes from ventilation will all have a detrimental effect.”

The application says that the takeaway hopes to open from 11am until 11pm seven days a week.

A statement submitted with the application says: “The current retail unit known as Smalley Stores has been closed for a period of more than five years.

“Before its closure, it was a local retail facility selling various goods to the locality.

“Whilst the retail has been previously closed it once played an important role within the village, which has no other local convenience store – the nearest facility being the Co-op store in the nearby village of Horsley Woodhouse.

“It is proposed that the retail unit reopens in April 2020.

“The applicant has identified a local need for a hot food takeaway within the village and considers that such a venture will be a success. The hours he has applied for is not considered to be unreasonable.

“The building will be provided with highly efficient filters to prevent unwanted odours from escaping from the building.

“The hot food takeaway will help supplement trade for the retail unit.

“The established retail unit will bring back into the community an important local facility. The hot food takeaway will provide another community facility.

“The nearest hot food takeaway other than the application site is some 1.2km away in Horsley Village.”
