Man breached non-contact order by texting his ex

A jilted ex is facing sentencing after he breached a ban not to contact his former partner.

Chesterfield magistrates’ court heard on Wednesday, June 1, how Shaun Buxton, 24, of Carter Lane East, South Normanton, sent 14 texts and five voicemails to his ex despite a non-molestation order.

Prosecuting solicitor Jennifer Fitzgerald said: “His partner sought an injunction and non-molestation order and there is a condition he can’t contact her or go within 100metres of her apart from allowing for child contact.

“Since the order his ex has received five voicemails and 14 texts none of which were answered.

“The texts were to do with asking after their children and that he couldn’t believe she had imposed an order against him and he also asked if they could get back together.

“The voicemails were silent and there was one of him singing and another with his mates talking and that supports his claim that these were accidental.”

Buxton accepted he had been given a restraining order and confirmed he had sent texts breaching the order.

He pleaded guilty to breaching the order five days after it had been imposed on May 5.

Defence solicitor Denny Lau said Buxton was upset after the end of a five-year relationship involving two children.

Mr Lau added that Buxton could not understand why a non-molestation order had been imposed and he was frustrated but there was never any question of threats during his messages.

Magistrates adjourned the case until June 22 to consider a probation report before sentencing Buxton.
