Man banned from seeing ex was caught at her home

A man who had previously assaulted his ex-partner has had his restraining order extended after he was caught at her home.

Chesterfield magistrates’ court heard on Wednesday, March 9, how Gareth Price, 37, was found hiding behind a bedroom door at the victim’s address in Tibshelf.

Prosecuting solicitor Sarah Haslam said: “The probation service called police with concerns for the victim because they believed he was breaching a court order.

Price told police he knew he was not meant to be there but said he had no where else to stay and at the time he wanted to get back with his partner.

The court heard how his ex-partner had allowed him to stay a couple of nights and she had said she was confused and wanted to help.

Price, of Nottingham Road, Long Eaton, pleaded guilty to breaching the order in November which was imposed following convictions for battery and criminal damage towards the same complainant.

Defence solicitor Peter Jones said Price is getting mental health support and has had no contact with the complainant since the breach.

District Judge Andrew Davison sentenced Price to an 18 month community order with a Rehabilitation Activity Requirement and a Building Better Relationships programme.

He was also fined £100 and must pay £85 costs and a £60 victim surcharge.

Price’s restraining order, banning contact with his ex-partner, was also extended to run for a further six months from April 13 to October 13.
