Homeless man is fined for being drunk and disorderly outside police station

Chesterfield magistrates’ court heard on Wednesday, March 30, how Daniel Jozefczyk, 34, of no fixed abode, was seen by police officers as they were leaving the station.

Prosecuting solicitor Rod Chapman said: “When police officers were leaving Glossop police station their attention was drawn to two men arguing outside the police station.

“One of the men was the defendant’s father and he said his son was very drunk and he also said his son had caused damage to a police emergency phone.”

Police removed Jozefczyk from his father’s vehicle where he had sought refuge, according to Mr Chapman, and as police dealt with the defendant on Ellison Street his father warned he could be violent when he is drunk.

Mr Chapman added that Jozefczyk used aggressive language towards a police officer and he was intoxicated so he was arrested for being drunk and disorderly.

Jozefczyk pleaded guilty to being drunk and disorderly after the incident on March 28.

The court heard that Jozefczyk was not charged for the damaged phone because his father declined to make a statement and the defendant had denied causing any damage and there was no evidence to provide a charge.

Defence solicitor David Gittins said Jozefczyk is an alcoholic but he is doing well under a community order which was previously imposed for two counts of assaulting a police constable.

Mr Gittins also explained that Jozefczyk had been remanded in custody for 45 hours before his sentencing hearing on Wednesday.

Magistrates fined Jozefczyk £40 and ordered him to pay a £20 victim surcharge and £85 costs.
