Richard Foster was staying with his partner at the Palace Hotel in Buxton on February 22, 2019, when the incident occurred, Chesterfield Magistrates’ Court heard on Tuesday, February 18.

He followed the youth, who was 17 at the time, into toilets and remarked about the size of his genitalia, said Katie Hamill, prosecuting.

When the teenager told him his comments were inappropriate and that “he was only 15”, Foster became angry, followed him out and punched him in the face, she said, adding that the youth had lied about his age in a bid to discourage the conversation.

The incident only came to light after the 39-year-old later got into a row with his partner and the police were called, and the teenager reported the incident to officers at the scene.

“The victim had gone to the Palace Hotel to attend a birthday party. In the toilet the defendant said something like ‘you’ve got a big schlong’,” she told the court.

“The defendant then became very aggressive, and when the victim tried to leave the toilets he punched him full-on in the face.

“He noticed that there was also a woman with the defendant who started shouting at him and apologised to the injured party.”

Later police were called to a domestic incident where officers struggled to get him into the back of the van, and then had to stop the vehicle and apply further restraints because Foster has banging his head repeatedly on the perspex, she added.

Foster, of Manor Road, Maltby, Rotherham, admitted common assault and resisting arrest when he appeared before the court.

Speaking in his own defence, he said: “I’m truly sorry and hopefully, with what I’ve been through and what I’m going to be going through, it won’t happen again.”

Magistrates gave Foster a 12-month community order to include 22 rehabilitation days, and ordered him to pay £100 in compensation. He was also fined £200 and told to pay £85 costs and a £90 victim surcharge.
