A motorist was stopped by police who were concerned about his driving and he was found to be over the drink-drive limit.
Chesterfield magistrates’ court heard this month how Philip Evans, 61, of Brecon Road, Merthyr Tydfil, Wales, passed a police car as he joined the M1 Junction 28 and was about to join the A38.
Prosecuting solicitor Peter Bettany said: “The car swerved and police followed on the A38 and Evans parked at Somercotes where he was joined by police.”
Evans, who denied bad driving, pleaded guilty to driving with an alcohol level above the legal limit after the incident in June.
Katie Fowkes, defending, said Evans is undergoing treatment which preyed on his mind, he had split up with his partner and had only consumed two pints of lager. Magistrates banned Evans from driving for 12 months, fined him £110 and ordered him to pay £85 costs and a £20 victim surcharge.
