Chesterfield magistrates’ court heard on Tuesday, February 28, how Macdaragh Fionn Deburca, 21, of Openacre, Ironville, crashed his mother’s Ford Fiesta on Brook Street, Heage, damaging a parked Peugeot 207 and initially fled the scene before returning.

Prosecuting solicitor Becky Allsop said: “The owner of the Peugeot had left her car parked outside and saw it was positioned further down the road and she saw a Ford Fiesta with someone in it and the defendant got out and she gave a description of him to police.

“She told how the male tried to get back in the Ford Fiesta and tried to move it unsuccessfully before staggering out of sight.

“The driver returned and said it was his mum’s car and someone had taken it from her house and he had been at the pub and had come down the street and just seen it.”

However, police were alerted and Deburca registered 53microgrammes of alcohol in 100millilitres of breath when the legal limit is 35microgrammes.

Deburca’s mother told police they had been drinking at a pub the night before the incident and she had given her son her house keys which had her car keys on the same bunch.

The defendant subsequently admitted to police that he had been out celebrating his 21st birthday and after he had been for a walk he saw his mum’s car and decided to take it for a drive without her consent.

Deburca pleaded guilty to exceeding the alcohol drink-drive limit, driving without a licence, driving without insurance and to taking a vehicle without consent and causing damage.

Magistrates sentenced Deburca to a 12 month community order with 150 hours of unpaid work.

He was also ordered to pay £85 costs, an £85 victim surcharge and was disqualified from driving for 15 months.
