Claims on the up

Sheffield firms have been warned to be prepared for an increasing number of claims from past employees and people who worked for firms they have taken over.

The warning came from law firm Kennedys, when its Sheffield office hosted a seminar for managers, directors, brokers and insolvency practitioners on liability for legacy disease claims.

Kennedys’ corporate restructuring and personal injury claims partner, Greg Wood said: “Companies are increasingly finding themselves faced with disease claims relating to alleged exposure to asbestos and noise from employees who worked for them, or for a company they purchased, many years previously. Even worse, many find they are unable to trace an insurance policy covering the event or the insurer is now insolvent.

“Such legacy disease claims are increasing and businesses in this region, given its industrial heritage, are seeing more than most.

“They require expert management and can be hugely damaging if mishandled.”
