Sex offender must pay £700 and do 150 hours' unpaid work after breaching order

A sex offender breached his order after he smashed the front door of his former rented home and failed to tell police about his new address.

Kyle Brewin, 25, who is now living in a caravan at The Canal Inn, at Bullbridge Hill, Ripley, damaged the front door of his former Apollo Homes’ property at High Street, Heanor, according to a Chesterfield magistrates’ court hearing.

Prosecuting solicitor told the hearing on Tuesday, September 20, that the property on High Street, Heanor, was rented out by Apollo Homes and the defendant was a tenant but owed over £2,000 in rent and that had caused problems.

Mr Cooper added: “He was given two weeks to leave the property and when he left he also left some possessions inside.”

Subsequently, Apollo received a phone call from an admin assistant, according to Mr Cooper, stating the defendant had been back into the property and trashed it and the front door had been ripped off its hinges.

Mr Cooper added that police were alerted and established that Brewin was on the Sex Offenders’ Register and had failed to inform them about his change of address so they could maintain a record of his whereabouts.

Brewin pleaded to damaging the door after the incident on April 3 and also pleaded guilty to breaching the terms of the Sex Offenders’ Register by failing to inform police of a change of address.

Mr Cooper said: “The Register requirements are there for a very good reason so police can keep track of potential, dangerous sex offenders and it’s important for public confidence that police take breaches seriously.”

Defence solicitor Felicity Coats said Brewin had discovered the locks at the property had been changed and he had entered the property to take back his belongings.

She explained that he only damaged the front door which he had previously fitted at the property despite claims he had also trashed the home.

Ms Coats added that Brewin believed his rent was being paid out of his benefits and he is disputing the rent arrears claim.

Brewin also failed to inform police of his new address, according to Mrs Coats, because he was going backwards and forwards to the hospital to see his partner who had influenza due to conditions at the property.

Magistrates sentenced Brewin to a 12 month community order with a Rehabilitation Activity Requirement and 150 hours of unpaid work.

He was also ordered to pay £530 compensation, £85 costs and an £85 victim surcharge.
