Man incited under-age youngster to have sex

A youngster from Derbyshire said she has gone from being 'a fun and bubbly girl to someone who gets angry a lot' after 'being taken advantage' of by a 19-year-old man.

Jamie Kirkman talked the girl into having sex after the pair met and started “kissing and cuddling”, a court heard, but a short time later he talked her into having intercourse.

The victim, who cannot be identified for legal reason and is in her early teens, told her mother who contacted the police.

Kirkman at first denied anything untoward had taken place but in a second police interview he confessed and pleaded guilty to inciting a child under the age of 16 to engage in sexual activity.

The girl stated: “Since this incident I have changed. I was always a fun and bubbly person and now I get really angry a lot and I don’t know why. I take it out on my friends. Having sex with him was not what I intended to do and I feel he took advantage of me.”

Sarah Allen, prosecuting at Derby Crown Court, sitting at Southern Derbyshire Magistrates’ Court, said the incident took place last autumn. She said he and the girl had been talking on social media and arranged to meet.

Miss Allen said: “They were hugging and kissing and that soon led to them having sex. He later told the police he knew what he was doing was wrong and stopped.”

Christopher Brewin, defending, said Kirkman’s lack of maturity was a factor. Recorder David Chinery handed Kirkman, of Radfords Row, Lower Lumsdale, Matlock, a 16-month prison term, suspended for two years with 100 hours’ unpaid work. Kirkman must pay £300 prosecution costs. The defendant is now on the sex offender’s register.

Recorder Chinery told Kirkman: “It is always sad to see someone before the court for the first time, especially someone that is able to make a good life for himself.

“You are a young man that really does know right from wrong and I think that you know this was wrong yourself.

“The tragedy is that knowing it was wrong you still went ahead with it.

“You breached her trust, she said that herself in her victim impact statement.”
