Man given conditional discharge after he grabbed his partner

A boyfriend barged open his partner's door during a booze-fuelled row and later grabbed hold of her to get her inside her home.

Chesterfield magistrates’ court heard on Wednesday, August 3, how Jamie Fullard, 26, of Devon Drive, Brimington, Chesterfield, had been drinking vodka with his girlfriend Michelle Tomlinson at a friend’s house before the row erupted.

Prosecuting solicitor Rod Chapman said: “They left their friend’s about midnight and could not remember what was said but Fullard accepts telling his girlfriend they needed to put the children to bed but she was reluctant to do that.

“He went around the block to calm down and came back through a side door which was unlocked but it had a chain which was found to have been pulled off when police later arrived.”

Fullard accepted barging through the door, according to Mr Chapman, and during the row Fullard’s partner went into the front garden and he put an arm around her back and another arm under her legs to carry her back into the address.

The court heard how Fullard’s girlfriend had called police during the row and they also received two abandoned calls before they arrived at the property on Lansdowne Road, Chesterfield, uninvited.

Fullard told police he had barged the door of the property open and accepted he had assaulted his girlfriend by carrying her back into the property from the garden.

The defendant pleaded guilty to assault and causing criminal damage.

Mr Chapman added that Fullard’s girlfriend Michelle Tomlinson is not supporting the prosecution against the defendant.

Fullard told the court: “It was a drunken mistake. I wanted to go home and I wanted to get out of there and it was an unnecessary argument.”

Magistrates sentenced Fullard to a 12 month conditional discharge but warned that if he commits another offence in the next 12 months he will be re-sentenced for the assault and damage offences with any new crime.

He was also ordered to pay £85 costs and a £20 victim surcharge.
