CHESTERFIELD: Parents of tot who died of dehydration to take legal action

The parents of a three-year-old girl who died from dehydration are pursuing legal action for clinical negligence.

Mylee Ward, of Gipsy Lane, Old Whittington, would have survived if she had been given fluid and if she had been examined properly, a coroner has ruled.

But instead Mylee was laid across two chairs and treated by A and E doctor Mushfikur Rahman, who failed to carry out basic blood or urine tests.

Now her parents Terrina-Ann Laughton and Kevin Ward are making a formal complaint against Dr Rahman to the General Medical Council and also pursuing a civil claim in clinical negligence.

Rebecca Coe, a clinical negligence solicitor, said: “The family have suffered such an immense loss of their beautiful, “bubbly, happy and giggly child”.

“This is a tragic case, which no one expects to come across in a modern British A and E department and which must never happen again.

“The inquest has brought back distressing memories for Mylee’s parents and they have asked for privacy at what is a very emotional time for the whole family.”

Coroner Robert Hunter told Mylee’s parents that basic medical checks were not carried out when she was admitted to the hospital last March.

He added: “Had she been admitted and fluids given, on balance, she would have survived.”

Mylee suffered from a brain disorder which meant her development was delayed and she was unable to speak.

Her parents called 111 after she had not drunk much for a couple of days and paramedic agreed she needed hospital treatment and took her to hospital.

But after being examined by Dr Rahman she was sent home with antibiotics and found dead in her play pen by her mother the following day.

A spokesman for Chesterfield Royal Hospital said they had taken the corner’s comments on board and would be making further improvements.

He added: “Chesterfield Royal Hospital will do all it can through the NHS legal process to help Mylee’s parents resolve any claim as quickly as possible.”
