A STUDENT should not be extradited to the US over alleged copyright offences because he was providing the same service as Google, a court heard.

Richard O’Dwyer, 23, originally of Bolsover, could face jail if convicted over running the website TV Shack which provided links to films and TV shows.

When he appeared before London magistrates last week his barristers argued his conduct was not an offence in this country because the site provided links, not content, and so he should not be extradited.

This was contested by the US Government’s representative.

Richard, a Sheffield Hallam University student, must return to court for a second hearing on November 22.

Speaking after the hearing his mum Julia O’Dwyer, who is helping him fight the extradition, said: “We are feeling quite positive because our barristers made a good argument.

“There is just no sense of proportion to this at all.”
