Chesterfield magistrates’ court heard on Friday, December 4, how Collette Yates, 24, of Sherwood Street, Stretton, had been drinking at a friend’s round the corner from her home when she decided to drive to get herself and her children home.

Prosecuting solicitor Becky Allsop said: “A witness told how he had seen Yates’s car collide with a parked van and it appeared that she had left her foot on the accelerator and shot off and hit a neighbour’s wall. Her five-year-old hit the dashboard with his face.”

The witness, according to Mrs Allsop, said he dragged the child out and he was screaming and his face was covered in blood and the witness went back to the vehicle and also dragged her younger, second child out.

Yates was breath-tested and recorded at more than twice the legal drink-drive limit. She pleaded guilty to exceeding the alcohol drink-drive limit and having no insurance after the incident in November.

Bertie Mather, defending, said: “Ms Yates had been at a friend’s and had three or four glasses of wine and had walked there with the intention of walking back. But the weather was inclement and the children did not want to walk and she foolishly made a decision to go back to get her car only 300 yards away to drive the children home. She said she became distracted by the child in the front and as she passed a van the wing mirrors collided and she tried to brake and over-corrected in gravel and collided with a wall.”

Mr Mather added Yates was sorry. Magistrates fined her £110 and she must pay £85 costs and a £20 victim surcharge, She was also banned from driving for 24 months.
