Failed Ripley thief is spared from a jail term

Chesterfield magistrates’ court heard on Tuesday, September 1, how Kenny Povey, 19, of Rowan Avenue, Ripley, tried to steal two cars in Alfreton and stole a set of motorcycle keys.

Prosecuting solicitor Neil Hollett told a previous hearing that police received a call about 6am from a witness who had been woken by a disturbance and as she looked on to King Street she saw a male near her vehicle. She had also been woken at 4am, according to Mr Hollett, after a car horn had sounded.

The woman told police she had seen the defendant on a wall. Mr Hollett added that an attempt had been made to hot-wire the woman’s vehicle and another neighbour discovered her car had been moved and tampered with. Povey’s passport was found on the passenger seat of the second vehicle, according to Mr Hollett.

Povey pleaded guilty to two counts of attempting to steal a vehicle and one count of stealing motorcycle keys after the incidents on June 13.

He also admitted breaching a community order and he was re-sentenced for the original offences relating to the order of assault and possessing cannabis.

Defence solicitor Felicity Coats said Povey has problems with alcohol and drugs, and his offending was unsophisticated. Magistrates sentenced Povey to 12 weeks of custody suspended for 12 months. He was also ordered to pay an £80 victim surcharge, £85 costs and a £180 court charge.
