A MUM of two who admitted a £35,000 benefit fraud was spared jail by a judge because of her children.
Recorder Simon Ward handed Pamela Fullwood, 35, a six-month prison sentence suspended for 12 months at Derby Crown Court.
Fullwood had wrongfully claimed the cash after previously telling the authorities that only her and her two children lived at her Birkin Avenue home.
She said that her husband David Fullwood lived with his mother and stayed at her house three nights a week but when Mr Fullwood started a new job he gave his address as Birkin Avenue, New Tupton, and the fraud was uncovered.
Mitigating, David Webster said Fullwood was “terribly ashamed.”
Sentencing Fullwood, Recorder Simon Ward said: “Members of the public quite rightfully get angry about cases like this.
“I have taken this action not for your sake but for the sake of your family.”
He also ordered the defendant to repay the money and to complete 100 hours of unpaid work.
